Promotion Terms

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the terms and conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the terms and conditions.  Please retain a copy for your information.

1. Only open to residents of England aged 18 or over, excluding employees of any company in the Heineken group and any person whom, in the Promoter’s reasonable opinion, should be excluded due to their involvement or connection with this promotion.  OFFER NOT AVAILABLE IN SCOTLAND, WALES OR NORTHERN IRELAND

3. How to take part –  In the venue entry route (On trade) 
In order to take part in this promotion for purchases made in the on-trade participants should follow the steps noted below:
Purchase a pint of MALTSMITHS in a participating venue.  Subject to availability.  Service is at the discretion of the bar staff.
Participants should request a receipt from the venue.
Participants should photograph their receipt.
Participants should go to https://www.checkoutsmart.com/deal/13071 follow directions to Checkout Smart.
A Checkout Smart account will be required to complete the redemption.
Participants will be required to upload a photograph of their receipt. Participants are advised to retain their receipt in the event that further verification is requested by the Promoter.
All photographs of receipts must conform to the Receipt Acceptance Criteria set out below. No payments will be made for receipts failing to satisfy this criteria. 
 Checkout Smart will reimburse participants for the cost of their pint of MALTSMITHS as shown on the receipt up to a maximum of £6.

4. How to take part – Retailer entry route (Off trade) 
In order to take part in this promotion for purchases made in the off-trade participants should follow the steps noted below:
Purchase a 660ml bottle of MALTSMITHS from participating retailer. Subject to availability.  Service is at the discretion of the checkout staff.
Participating Retailers – Asda, Morrisons, Sainsburys and Co-op.
Participants should request a receipt from the retailer.
Participants should photograph their receipt.
Participants should go to https://www.checkoutsmart.com/deal/13070 and follow directions to Checkout Smart.
A Checkout Smart account will be required to complete the redemption.
• Participants will be required to upload a photograph of their receipt. Participants are advised to retain their receipt in the event that further verification is requested by the Promoter.

5. Receipt Acceptance Criteria (See Checkout Smart General Terms & Conditions for more detail) 
Receipts uploaded to Checkout Smart must meet all of the following standards:
a. Clearly show that a qualifying MALTSMITHS product has been purchased.
b. Show the address in England where the purchase was made.
c. Show the date of the purchase.
d. Images with EXIF data removed will be rejected.
e. Images subject to any image manipulation will be rejected.
f. Double sided receipts may be uploaded in two separate images.
g. The Promoter shall have sole discretion in judging if a receipt is acceptable. Unacceptable receipts will be rejected and the participant will be given one opportunity to re-upload the receipt. If the receipt is rejected a second time the participant will not be allowed to take part in the promotion using that receipt.


6. Checkout Smart will refund the actual purchase price paid for the relevant MALTSMITH product subject to the limits contained in condition 4, as evidenced by the receipt provided in accordance with the acceptance criteria in condition 5..

7. Entries must be made personally.  Entries made through agents/third parties, bulk entries or automated entries are invalid.

8. This offer is limited to one entry per person. No multiple entries from a single individual will be valid.

9. The Promoter accepts no responsibility for lost or stolen receipts.

10. The Promoter accepts no responsibility for lost, damaged, incomplete, illegible or delayed receipts uploaded to the website, such entries will be void.  Proof of sending is not proof of receipt and the Promoter does not accept any responsibility for the non-receipt or the late receipt of uploads due to network failure or for any associated costs to participants.  

11. No entries submitted via any other means than the means described under conditions 3 and 4 will be accepted.  The Promoter does not guarantee uninterrupted or secure access to the web entry route.  Any mechanical reproduction or automated entries is prohibited, and any use of such automated devices will cause disqualification.  

12. The promotion will begin on 14th June 2019 and will end on 31st December 2019 subject to earlier termination in connection with condition 13 of these terms and conditions.   

13. £140,000 will be reimbursed to participants in the course of this promotion. Once this sum has been reached no further reimbursement will be provided. The Promoter will not be liable for any reimbursement where a purchase has been made but the receipt not uploaded prior to the cap of £140,000 being reached. Reaching the cap of £140,000 will bring this promotion to an end. For the avoidance of doubt the £140,000 cap will cover both entry routes. 

14. The Promoter reserves the right to verify all entries to refuse and to award reimbursement and/or refuse further participation and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of entry requirements or otherwise where a participant has applied for reimbursement using fraudulent means.  The Promoter will be the final arbiter in any decisions and these will be binding and no correspondence will be entered into.  

15. The decision of the Promoter in all matters is final and binding and no correspondence will be entered into.

16. The Promoter is not responsible for any third party acts or omissions.

17. The Promoter does not guarantee that the promotion will be free from disruptions, failings or cancellations.  The Promoter is not liable for such disruptions, failings or cancellations unless they are caused by the Promoters own negligence.  

18. The Promoter reserves the right to cancel or amend this promotion at any time for any reason. 

19. All taxes (including without limitation national & local taxes) in connection with any payment and the reporting consequence thereof, are the sole responsibility of the participant.

20. These rules and any dispute or difference arising out of or in connection with them shall be governed by and construed in accordance with English law.  The Promoter and each entrant irrevocably agrees to submit to the exclusive jurisdiction of the Courts of England and Wales over any claim or matter arising under or in connection with these rules or the legal relationships established by this agreement.
